Terms & conditions

These terms and conditions apply to your booking of expedition with us. Please read them carefully, as you will be legally bound by them.

By purchasing the expedition, you accept the present Terms and Conditions. In case you do not accept any of the Terms and Conditions of EDUOUTINGS LLC (EDUOUTINGS hereafter) you will not be able to take part in the expeditions.

I. Your Contract

These Booking Terms and Conditions together with our cookie and privacy policy, the information contained in your brochure and any other written information that we brought to your attention before we confirmed your booking, form the basis of your contract with EDUOUTINGS LLC whose registered office is at Standard Chartered Tower, Emaar Square, Downtown Burj Khalifa.

When you book an expedition with us the contract between us will exist as soon as you or your travel agent asks us to confirm your booking. We then become responsible to provide you with the expedition arrangements you have booked and you become responsible to pay for them, in each case subject to these terms and conditions. You will also become responsible to pay for any additional arrangements made by us on your behalf including International Flights not included in any expedition, optional excursions, travel insurance or other arrangements requested by you and booked.

When you make a booking you guarantee you have the authority to accept and do accept on behalf of your party the terms of these booking conditions and accept responsibility for making all payments to us for all members of the party. Furthermore, you consent to our use of your personal data in accordance with our Privacy Policy and you are authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements).  We are unable to accept provisional or conditional bookings. We will send all documents and other information to you and you will be responsible for ensuring that all other members of the party are kept fully informed.

A confirmation invoice which you should check as soon as you receive it will be sent on receipt of your deposit. If you wish to change or cancel any arrangements later you may have to pay an amendment or cancellation charge and additional costs (as applicable) which may be as much as the whole of the original price of your arrangements. Only one invoice and one set of documents will be issued. No verbal amendments may be made by either party to these written booking conditions.

If you book your expedition through a travel agent all communication must be through that agent. Please quote your booking reference number in all communications.

You are responsible for complying with any visa or other entry requirements for you or any of your party for the destinations being visited during the expedition.

II. Itineraries

The itineraries published on this website and in any other sources serve as examples only. Real itineraries of any expedition  (including all scheduled landings and excursions) in polar or remote regions are heavily dependent on weather and ice conditions. Occasionally, conditions and/or safety concerns require itinerary changes. The Captain (incase of sailing expeditions) and the Expedition Leader (in case of all expeditions) will accordingly make every effort to find the best alternative to the original itinerary while keeping passengers informed and updated. It is understood that such decisions will be made in the interests of all passengers and with regard to the safety of the vessel. Itinerary changes are not subject to passenger approval/consent and in the event of such a change no refunds or price adjustments are possible.

The Operator expressly reserves the right to change the itinerary, the date or place of departure due to weather conditions, availability of anchorages, political conditions and other factors beyond Operator’s control without consulting the participants. Placement of a booking with us amounts to an acknowledgement that itinerary changes are possible.

III. Reservations and Payments

Reservation and payment terms vary per expedition. These will be shared in detail by our expedition consultant at the time of inquiry of reservation. Incase you don’t receive these details, please reach us out at [email protected]

All Payments are to be made in the agreed currency indicated on the invoice (AED, USD, Euro, Pounds). The deposit can be made by credit card or via bank transfer. The final payment is to be made via bank transfer.

The date of payment is considered to be the date of crediting the funds to our account.

In case of payment delay we have the right to cancel your expedition with prior notice.

IV. Booking Cancellations and Refunds

All requests for cancellation must be made in writing. The cancellation and refund terms vary per expedition. These will be shared by our expedition consultant at time of inquiry or reservation. Incase you don’t receive these details, please reach us out at [email protected]

V. Expedition Cancellations

Operator reserves the right to cancel any departure due to insufficient reservations up to eight weeks before the date of departure (passengers may be offered alternative expedition dates).

In the very unlikely event that expedition is cancelled prior to departure the rules and amount of refunds will be communicated at the time of unlikely event, and vary per operator.

Neither the Operator nor we are responsible for any costs or penalties relating to air transport or other services that are cancelled.

VI. Force Majeure

Force Majeure means any event beyond a Party’s reasonable control, which is unavoidable and extraordinary including without limitation acts of God, natural catastrophes/adverse weather conditions, epidemics, pandemic or any other viral outbreaks, global health emergencies events, contaminations, public unrest/strikes, war, changes in laws or regulations, coercive measures by the state or quarantines, which unreasonably hinder or temporarily make the fulfilment of the route and the services during the expedition partly or completely impossible, shall entitle the Operator to postpone/suspend the performance of any travel services or the pursuit of the route for the duration of the hindrance in days.

In case the Force Majeure event occurs prior to the departure the Operator will use commercially reasonable efforts to offer the closest available or any substitute expedition. Where possible the Operator might offer credit or voucher for future use and will solely be based on their decision. In such case, EDUOUTINGS will notify as soon as possible following the occurrence or date of commencement of such Event of Force Majeure giving information on the nature and the effects of the force majeure event.

It is understood that the force majeure policy will be applicable unless any special law or regulation is enacted regulating and/or determine the duration and/or the effects of the Force Majeure Event, of which the provisions will prevail of this clause.

In case the Force Majeure event occurs while the expedition is in progress the Operator shall use their best efforts for the contract to survive and to mitigate the impact of Force Majeure event on expedition performance.

VII. Participation of Children

The minimum age requirement of children that can safely participate in each expedition varies. Please get in touch with our expedition consultant during inquiries or bookings to know the applicable policy.

VIII. Eligibility and Medical Information

In case of sailings, there are no specific physical requirements for travel in polar regions, but there might be for land expeditions. Please ensure to read Special Notes section at bottom of each itinerary. Additionally our expedition consultant will also inform you of such requirements. Please also note that there is no specialized medical assistance available in many regions where expedition is offered. Passengers with certain medical/health issues may not be appropriate for this type of expedition and are advised to exercise appropriate caution. Our medical information form lists a number of these conditions.

Prior to boarding ships for sailing expeditions, specific passenger information is required by Operator for passenger safety and for international reporting regulations. Required information must be completed in the forms provided by Operator and submitted at least 60 days prior to departure. Final documents cannot be issued for passengers whose information has not been received.

We require all passengers to submit basic medical information prior to departure. Upon receipt of that basic medical information, specific physical conditions may necessitate additional documentation from a passenger’s physician certifying fitness to travel on a polar expeditions voyage. If additional medical confirmation is requested, boarding in case of sailings will not be allowed absent receipt of that confirmation. Please note that medical information will, of necessity, be available to designated Operator’s staff.

Please note that regardless of general eligibility there may be instances where environmental conditions require a level of fitness/mobility. In these cases, individual participation in the landing(s) in question may be restricted by the Captain, Expedition Leader, or assigned doctor on-site.

IX. Insurance

It is a condition of the contract with us that every member of the booking has travel insurance in force for the entire duration of the booking, covering the cancellation of the booking which might occur by the Operator, suppliers or any Force Majeure. Due to the nature of activities and regions the expeditions are offered, All passengers are additionally required to carry valid evacuation and repatriation insurance which must contain medical and evacuation coverage.

As any potential evacuation from the polar regions can cost up to: US$150,000 for 2019, increasing to US$200,000 for 2020 for the Arctic and up to US$200,000 for Antarctica, we recommend that no policy carries less than this amount of coverage. As part of pre- departure forms both EDUOUTINGS and The Operator will require information as to the insurance company, policy number, amount of coverage and 24-hour contact number. Any risks, not covered by the insurance policy provided, are to be covered by passengers at his/her disposal and at his/her own expense.

Any cruises in non-polar regions require a minimum of US $150,000 of evacuation insurance coverage.

Failure to get such an insurance may result in cancellation of your expedition.

X. Responsibility

The payment of a deposit or full payment for a reservation for expediting shall constitute consent to all the provisions contained herein.

EDUOUTINGS or The Operator or its agents are not responsible for any costs or penalties relating to air transport or other services that are cancelled. EDUOUTINGS or the Operator are not liable for failure to provide the services or accommodations offered to the extent that such services or accommodations cannot be provided due to force majeure or other circumstances beyond its control.

Operator is a qualified tour operator that organizes and administers its tours. Operator will provide services in conjunction with local operators and air and sea operators. The designated operator(s), in turn, acts only as an agent for any transportation carrier, hotel, ground operator, or other suppliers of services connected with these tours (“other providers”), and the other providers are solely responsible and liable for providing their respective services. The passenger tickets in use by the carriers shall constitute the sole contract between the carriers and the passenger; the carriers are not responsible for any act, omission, or event during the time participants are not aboard their conveyances.

EDUOUTINGS, The Operator and its designated service providers shall not be held liable for (a) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (b) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control.

The participant waives any claim against EDUOUTINGS and The Operator for any such loss, damage, injury, or death. In the event of Itinerary change due to any unforeseen circumstances or due to force majeure EDUOUTINGS and The Operator are not to be held liable for any costs incurred by passengers in this case and no refunds or price adjustments are possible.

By registering for our expeditions, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for him/herself or other participants. EDUOUTINGS, The Operator and its designated tour operator reserve the right in their sole discretion to accept, decline to accept, or remove any participant from a voyage. Operator reserves the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant, or if they deem it necessary for the comfort, convenience, or safety of participants.

If a passenger misses any scheduled sailing of the vessel from any port or place, including any stopover, EDUOUTINGS and The Operator shall not be liable for any costs, expenses or damages incurred by the passenger as a result of his/her action and no refund of fare shall be granted.

XI. Changes in Terms and Conditions

We reserve the right to change, with prior notice, the present Terms & Conditions.

XII. Acceptance of Terms and Conditions

Acceptance of the initial services to be provided on the trip shall constitute an acceptance by the trip member of these terms and conditions. On advancement of deposit to us, the depositor therefore agrees to be bound by the above-recited Terms & Conditions.

Privacy Policy

This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.

We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Service refers to the Website.

Country refers to: United Arab Emirates

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

Personal Data is any information that relates to an identified or identifiable individual.
